“Design and construction of the S19 road at the section from the Białystok Zachód junction (without the junction) to the Białystok Księżyno junction (with the junction)” – withdrawal from the contract
The Management Board of Budimex S.A. announces that on 7 December 2022 it received a letter from the General Directorate for National Roads and Motorways, Branch in Białystok, regarding withdrawal from the contract concluded with Budimex S.A. on 9 December 2020 (as subsequently annexed) for the task: “Design and construction of the S19 road at the section from the Białystok Zachód junction (without the junction) to the Białystok Księżyno junction (with the junction)” the signing of which the Company announced in current report No 70/2020 of 9 December 2020.
The reason for the withdrawal from the contract indicated in the letter from the General Directorate for National Roads and Motorways is the final annulment of the decision on environmental conditions issued by the General Director for Environmental Protection on 4 June 2021 and the preceding decision of the Regional Director for Environmental Protection in Białystok of 14 August 2019, concerning the implementation of the contract.
At the same time, the Management Board of Budimex S.A. advises that, according to a letter from the General Directorate for National Roads and Motorways received today, “the events related to the annulment by the Provincial Administrative Court of the final decision of General Director for Environmental Protection of 4 June 2021 and the preceding decision of Regional Director for Environmental Protection of 14 August 2019 were not influenced by any of the signatories to the contract.”
The reason for withdrawal from the contract does not lie with Budimex S.A.
The Management Board of Budimex S.A. is analysing the representation on withdrawal from the contract received and will notify the market in case of any significant decisions on the matter.
