Construction of the “D35 Džbánov – Litomyšl” road – signature of a contract
The Management Board of Budimex S.A. announces that on 07.03.2024
it became aware of the signing of a contract between Budimex S.A. and Ředitelství silnic a dálnic s.p. with its registered office in Prague, the Czech Republic,
regarding the construction of the “D35 Džbánov – Litomyšl” road. The contract enters into force on the date of its publication by the Ordering Party
in the Czech contract register.
The information that our bid had been selected as the most advantageous one was published on 14.02.2024 in current report No 8/2024.
Contract value: CZK 3,423,662,473.15 net
Works commencement date: as soon as possible after signing the Contract
Works completion date: 1,394 calendar days
Guarantee period: 120 months
Statutory warranty period: 120 months
Advance payment: max. 25% of the net Contract Amount, but not more than CZK 250 million net
Payment terms: within 30 days from the date of the Ordering Party’s receipt of a VAT invoice correctly issued by the Contractor and accompanied by all relevant documents (partial invoices), within 60 days from the date of the Ordering Party’s receipt of a VAT invoice correctly issued by the Contractor and accompanied by all relevant documents (final invoice).
Bank performance bond: 10% of the net contract amount in the form of a bank performance bond
Maximum amount of contractual penalties paid by the Contractor: 30% of the net contract value
Contractual penalties paid by the Contractor: from CZK 100 thousand to CZK 1.9 million per day for failure to achieve the Milestones; CZK 1 million per day for failure to complete the subject matter of the contract on time; CZK 15 million for any case of breach of staff qualification requirements.
The contract shall be governed by the law of the Czech Republic.
Other terms and conditions of the contract do not differ from the market standards.
The value of the Contract exceeds the threshold of PLN 172,381 thousand net.
